Terms of Service

These Terms of Service (“Terms”) govern your use of the Precisely Fasion website at www.preciselyfasion.com (the “Site”) and any purchases you make from us. By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Who we are
Precisely Fasion LLC, a Utah limited liability company, operates the Site. Our mailing address is 346 Ridge Dr, Alpine, UT 84004, USA. You can reach us at [email protected].
2. Eligibility
You must be at least 13 years old to use the Site (16 if you’re in the European Economic Area or the United Kingdom). If you’re under 18, you may only use the Site with a parent or guardian’s permission. By using the Site, you confirm that you meet these requirements.
3. Your account
You can shop as a guest or create an account. If you create an account, you agree to provide accurate information, keep your password confidential, and accept responsibility for activity under your account. We may suspend or terminate accounts that violate these Terms or are used for fraud.
4. Products, pricing, and availability
We try to describe our products and show colors as accurately as we can, but actual appearance can vary based on your screen and lighting. Inventory is limited and prices can change without notice. Promotions may be subject to additional terms posted at the time of the offer.
If we discover a pricing or description error after you place an order, we’ll contact you and either confirm the corrected order with your approval or cancel and refund it.
5. Orders and acceptance
Placing an order is an offer to buy. We accept your offer when we ship the items, not when we send the order-confirmation email. We may decline or cancel an order at our discretion — for example, if a product is out of stock, an address can’t be verified, or we suspect fraud.
6. Payment
We process payments through Stripe. Stripe receives and stores your card information directly; we don’t see or store full card numbers. Applicable sales tax is calculated and added at checkout. By placing an order, you authorize us (through Stripe) to charge your payment method for the total order amount, including tax and shipping.
7. Shipping and risk of loss
We currently ship within the United States only. Shipping times are estimates, not guarantees. Risk of loss and title for purchased items pass to you when we hand the package to the shipping carrier. If a package is lost or damaged in transit, contact us within 7 days of the expected delivery date so we can help.
8. Returns
Eligible items can be returned within 30 days of delivery. See our Refund & Returns Policy for the full terms, including condition requirements, return shipping, and how refunds are issued.
9. Intellectual property
The Site and its content — including text, photography, graphics, logos, and the “Precisely Fasion” name and marks — are owned by Precisely Fasion LLC or our licensors and are protected by copyright, trademark, and other laws. You may view and download content for personal, non-commercial use. You may not copy, modify, redistribute, scrape, or use our content for commercial purposes without our written permission.
10. Acceptable use
Don’t use the Site to do anything illegal, harmful, or abusive. In particular, don’t: place fraudulent orders, use bots or scrapers, interfere with the Site’s operation, attempt to access accounts you don’t own, or upload content that infringes others’ rights. We can suspend access for any of these.
11. Third-party links and content
The Site may link to or embed content from other websites we don’t control. We’re not responsible for those sites’ content, policies, or practices.
12. Disclaimers
The Site and our products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free, or secure, and we don’t guarantee that color, fit, or finish of products will match your expectations exactly.
13. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Site or any order is limited to the amount you paid us for the order at issue. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if we’ve been advised of the possibility. Some jurisdictions don’t allow these limitations; if you live in one of those jurisdictions, the limitation applies to the maximum extent permitted by your local law.
14. Indemnification
You agree to indemnify and hold Precisely Fasion LLC and our officers, employees, and contractors harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.
15. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. If a dispute arises, we ask that you first email us at [email protected] with a clear description of the issue and what you’d like us to do. If we can’t resolve it within 30 days, you and we agree that any lawsuit will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to jurisdiction and venue there.
16. Changes to these Terms
We may update these Terms from time to time. The current version is always posted here with an updated “Effective” date at the top. If we make material changes, we’ll do our best to notify you (for example, via a banner on the Site or an email if you have an account). Your continued use of the Site after changes take effect means you accept the new Terms.
17. Other terms
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
Entire agreement. These Terms, together with our Privacy Policy and Refund & Returns Policy, are the entire agreement between you and Precisely Fasion LLC about the Site.
No waiver. If we don’t enforce a provision once, that doesn’t mean we waive our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
